Agreement to these Terms
These Terms of Service (“Terms”) are an agreement between you and Vance Posey, an individual doing business as Project RNDR in Austin, Texas (“Project RNDR,” “we,” “us,” or “our”), concerning the Project RNDR website and AI rendering workspace (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of a company, client, or other organization, you represent that you have authority to bind that organization. In that case, “you” includes the organization.
Accounts and eligibility
You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate account information, maintain the security of your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account and for managing access to your company workspace.
You may not share credentials in a way that bypasses account limits or access controls. We may require email verification or other reasonable steps to protect the Service.
Your content and permissions
You retain ownership of source images, visual references, prompts, project information, and other material you submit (“Your Content”). You represent that you have all rights and permissions needed to upload, process, generate from, store, and share Your Content through the Service.
You grant Project RNDR a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, and create technical or generated derivatives of Your Content only as needed to provide, secure, and support the Service you request. This license ends when the content is deleted, except where limited retention is required for backups, security, legal compliance, or safe completion of deletion workflows.
You are responsible for obtaining client consent where project files contain personal, confidential, proprietary, or location-related information.
AI-generated content and professional judgment
Project RNDR uses third-party AI services to create and edit images. AI outputs may be inaccurate, incomplete, inconsistent, or unexpectedly similar to other material. We do not guarantee that an output will preserve every requested detail, be unique, be free of third-party claims, or be suitable for a particular purpose.
Project RNDR concepts are visualization aids, not construction documents, architectural plans, engineering advice, code-compliance determinations, bids, specifications, or guarantees of final installed results. You must independently review dimensions, materials, costs, feasibility, safety, code requirements, intellectual-property concerns, and client approvals before relying on an output.
As between you and Project RNDR, and to the extent permitted by law, you may use generated outputs created for your workspace. Laws regarding AI-generated content continue to evolve, and we do not promise that any output qualifies for copyright or other exclusive protection.
Acceptable use
You may not use the Service to:
- Break the law, violate another person’s rights, or process content without authorization.
- Upload malware, attempt unauthorized access, probe security controls, or interfere with the Service.
- Bypass quotas, generation-credit accounting, storage limits, tenant boundaries, or technical restrictions.
- Create deceptive impersonation, exploitative sexual content, unlawful discrimination, or content that facilitates harm.
- Reverse engineer the Service except where applicable law expressly permits it.
- Resell, sublicense, or provide the Service as a competing hosted product without written permission.
We may investigate suspected misuse and suspend access when reasonably necessary to protect users, providers, or the Service.
Generation credits, access, and future billing
Some operations consume generation credits. Credits measure Service usage; they are not money, have no cash value, cannot be transferred, and may expire or reset according to the access rules shown in the Service.
Billing is not currently active. Pricing pages describe planned tiers and may change before paid subscriptions launch. Before charging you, we will present the applicable price, renewal terms, taxes, cancellation process, and any additional payment terms for your agreement.
We may change free access, quotas, storage allowances, model availability, or feature availability with reasonable notice when practical.
Project RNDR materials and feedback
The Service, software, interface, branding, documentation, and related materials are owned by Project RNDR or its licensors and are protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended business purpose.
If you provide feedback, you permit us to use it without restriction or compensation, provided we do not identify you publicly without permission.
Suspension, termination, and deletion
You may stop using the Service at any time and may request account deletion through settings. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay future charges, or use the Service in a way that could harm others or the Service.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, disclaimers, and limits of liability—will survive. Data deletion is handled as described in the Privacy Policy.
Service disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Project RNDR disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, Project RNDR will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, construction costs, or client disputes arising from the Service.
To the fullest extent permitted by law, Project RNDR’s total liability for claims relating to the Service will not exceed the greater of the amount you paid Project RNDR during the 12 months before the event giving rise to the claim or USD $100. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
Changes and general terms
We may update these Terms as the Service evolves. We will post the updated Terms with a revised effective date and provide additional notice when required. Continued use after the effective date means you accept the updated Terms.
If part of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. To the extent a dispute is not resolved informally and applicable law permits, you and Project RNDR agree to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
